Uber accident compensation

Uber has become one of the most widely used forms of transportation in Queensland alone, surpassing traditional Taxis.

However, it is not void of car accidents just like all other drivers on the road. As a passenger, you could, unfortunately, become injured in an Uber accident.

This post will provide information on what to do if you are involved in an Uber accident and how you can make a claim for personal injury compensation.

Am I covered if I’m in an Uber accident?

Uber has a number of levels of insurance with drivers that cover personal injury and damage to property.

As part of the vehicle’s registration, all drivers must have a current CTP (compulsory third party) insurance and vehicle insurance policy in place. Any injury claim can be made under the CTP insurance policy.

In addition to this coverage, Uber drivers are protected with public liability insurance up to $20 million dollars that covers personal injury and property damage outside of the Uber vehicle.

UberBlack, UberLUX and UberTaxi are all covered by commercial insurance policies managed by the owners of these vehicles.

What to do if I’m in an Uber accident?

First, call 000 and seek medical attention to make sure you are ok. These medical records will later be used as part of your compensation claim. Speak to your Doctor about obtaining these.

Obtain personal details from the Uber driver and other parties involved. You can take a photo of drivers licenses and the Uber car sticker.

Report the accident to Police via the https://forms.police.qld.gov.au/launch/TrafficIncident or visit your local police station when able.

Report the accident on the Uber app.

  • Make sure your contact details are up to date in the app.
  • Go to Your Trips.
  • Select the trip where the accident occurred.
  • Choose Select an issue, choose ‘I was involved in an accident’.
  • Complete the form with all the information about the incident and submit the form.
  • Uber will get in touch with you on your contact details.

How do I make a claim for compensation?

If you have sustained an injury, you can make a claim under the drivers CTP insurance.

To do so, complete the Notice of Accident Claim form. Your Doctor will need to complete pages 11 and 12 of the form. The Medical Certificate will also need to be completed to arrange funding for your treatment and rehabilitation.

Further, you will need to complete the Claimant Certificate to make statements about your claim. At this time, you may wish to speak with a Personal Injury Lawyer to ensure your claim is handled correctly so you receive your full entitlements.

If you are involved in a car accident with an Uber driver, call 000 if anyone is injured. Obtain details from the driver, license and other witnesses. Report the accident to Police and contact your insurer to lodge a motor vehicle accident claim as soon as possible.
