Time Limits You Need to Know Before You Claim
Most personal injury claims in NSW must be started within three years of the injury, under the Limitation Act 1969 (NSW). This general rule has exceptions, including for children and for injuries that aren’t discovered straight away.
Specific claim types carry their own, often shorter, deadlines. A compulsory third party (CTP) motor accident claim, for example, generally needs to be lodged within three months of the accident, while a workers compensation claim should be reported to your employer as soon as possible. How long do I have to make a personal injury claim in NSW?
In most cases, you have three years from the date of injury under the Limitation Act 1969 (NSW). Some claim types have shorter reporting windows, so it’s best to get advice as soon as possible after an accident or injury.
Do I have to go to court to get compensation?
No. Most personal injury claims in NSW are resolved through negotiation with the insurer or employer before reaching a courtroom. Going to trial is the exception, not the rule, and we’ll always explain your options at each stage.
