Conditions for Accessing Your Super Early

Most people access super when they are over the age of 65, or over the age of 60 and either retiring or transitioning to a retirement income stream. In some cases, you may also need to claim the superannuation of a loved one who has passed on. There are also additional conditions that may allow you to access your super earlier than for the reasons above, including:

  • On compassionate grounds
  • Suffering severe financial hardship
  • Diagnosed with a terminal medical condition
  • Temporary or permanent incapacitation
  • Through the First Home Super Saver Scheme
  • Departing Australia as a temporary resident
  • Termination of gainful employment with less than $20 in your super account.

If you’re not sure if you have a case for an easy claim, please do not hesitate to contact our team at Main Lawyers NSW.

Accessing Your Super Early for Financial Hardship

It’s estimated more than 5 million Australians experience financial hardship in their life, but most don’t know their super may be an option to help. Severe financial hardship is grounds for early release of a portion of your super to pay for immediate reasonable expenses. You can receive one payment of no more than $10,000, including tax, in any 12-month period.

To access your superannuation under financial hardship, you will typically need to:

  • Be receiving Commonwealth Government income support, such as unemployment benefits, for at least 26 weeks.

OR

  • Have reached your preservation age (between 55 to 65, depending on your date of birth), and have been receiving government assistance for at least 39 weeks.

Withdrawing from your super early typically impacts your tax amount, so you may need to pay extra fees. You can apply directly to your super fund, or if you’re having problems, reach out to our team at Main Lawyers.

Withdrawing From Your Super on Compassionate Grounds

In some circumstances, you may be able to withdraw from your super for compassionate grounds tp cover unpaid expenses or repay outstanding balances where you had to borrow money to cover expenses for:

  • Medical treatment for you or your dependent
  • Medical transport for your or your dependent
  • Modifications to your home or vehicle to accommodate special needs from you your dependent’s severe disability
  • Palliative care for you or your dependent’s terminal illness
  • Death, funeral or burial expenses for your dependent
  • Prevening foreclosure or forced sale of your home.

You’ll need to submit an application to the Department of Human Services in most cases. However, if you believe you have grounds for early access super on compassionate grounds, but have been denied, book a free consultation with our NSW superannuation lawyers to discuss your options.

Making a Total & Permanent Disability (TPD) Superannuation Claim

If you have total and permanent disability (TPD) cover through your superannuation, you may be able to apply for a TPD benefit, including withdrawing some or all of your super account balance on the grounds of permanent incapacity. This is one of the more difficult early super claims, however, you may still have right to funds even if your first application is rejected.

Like other conditions for withdrawing super early, receiving early release of super for permanent incapacity may affect your tax amount, increasing the fees you pay. Our NSW TPD claims lawyers can help you explore your options.

Advantages of Hiring a Self-Managed Super Fund Lawyer

Self-managed super funds give you the ultimate control and flexibility over your retirement investments. One of the many things you have control over is the insurances you include, such as:

  • Life insurance
  • Total and permanent disablement (TPD) insurance
  • Income protection insurance
  • Trauma insurance

While you’d like to hope you or your family won’t need to use these insurances, they can be saving grace for the ‘just in case’. Our NSW self-managed super fund lawyers can help you go through all your options and set up your fund so you’re covered for the unexpected. Working with a lawyer helps protect you and your family, as well as know exactly what premiums and other considerations are applied.
