Car Accident Back Injury Compensation

Back injuries are very common injuries sustained in car accidents. Many people suffer injuries and pain at the time of the accident but also for the rest of their life. It is not something that should be lightly overlooked as it can have devastating impact on your life.

Injuries to your back can be caused by a number of reasons if you are in a car accident. Whether you are hit from behind, the side or the front, all can cause injury to your back. You can sustain back injuries if you are the driver or passenger of a vehicle. The same can apply for pedestrian accidents or cyclists who are hit by a vehicle.

Often, we see many people who are unsure of what to do if they have injured their back in a car accident. In some cases, we have seen people who don’t think they are worthy or that their injury isn’t that serious enough to bring a claim. No matter the level of injury and pain to your back, we are specialist car accident lawyers. At Main Lawyers we always suggest injured people contact a specialist personal injury or motor vehicle accident lawyer to have your claim assessed. Never assume you are not entitled to be compensated, no matter how minor you think it may be.

Can I claim for back injury compensation for a car accident?

In short, yes. There are many different situations and time constraints that may limit your ability to claim. However, generally, if your back is injured in a motor vehicle accident you should seek advice from a personal injury compensation lawyer immediately.

We find that some people are afraid of bringing an action for fear of losing their employment or having their hours cut back, resulting in a loss of earnings. Some are also unsure whether it is even worth bringing a claim or that the process seems too overwhelming. Regardless of the reason, it is important to bring a claim so that you may obtain treatment. This will avoid the risk of further complications or discomfort over time.

Another thing to note is that an injury claim needs to be made as soon as possible as the accident needs to be within three years to be eligible to claim. Claims outside of these 3 years can be a lot more difficult to win outside of the limitation period, however, here at Main Lawyers, we specialise in getting the most from your claim and may still be able to progress with a claim outside this window.

There are a number of different types of compensation depending on the situation and whether the injury is minor, moderate or serious.

How do I make a car accident injury claim?

If you receive an injury in a motor vehicle accident, there are certain steps that you must undertake before you can bring a claim.

For starters, you will need to complete a police car accident report. every driver involved in the incident is obligated to file a police report when an injury occurs. This doesn’t always need to be at the time of the accident, if you are unaware someone was injured you may need to complete it at a later date. For more info on this, you can check the QLD police service on how to report a motor vehicle accident to the police.

Next, you must report this injury and accident to your GP or doctor’s practice. There will need to be a record of the injury and a direct link of the injury to the accident. Once this is done you can request a motor vehicle accident medical certificate from your doctor.

Finally, you will need to get in touch with an expert injury compensation lawyer who knows the ins and outs of the claims process. This step is most important as there are certain restraints and time frames that must be correctly followed in order to make a successful claim. Your lawyer will then submit a Notice of Accident Claim form (for non-fatal injuries). This form can be completed yourself however we strongly recommend seeking legal advice to ensure you have the best chance possible.

At Main Lawyers, we’re to ensure your claim goes as smooth as possible and that you get awarded the maximum amount. Contact our professional team today for a free no-hassle consultation today!
